Witness advised Accused, if he was going to see his wife, to make up the quarrel between them. Accused replied that that was his business, and, pulling a revolver out of his breast pocket and pointing it, said, " If you don't clear out, I'll blow your brains out." Accused followed " a little distance towards Riddiford -'street,then turned round and began to run, witness following him. Accused came to witness's house, and ran round to the back gate. Witness heard a shot fired inside the house. Screams followed, then three more shots were fired in rapid succession. Witness ran to the back door, and was met on the threshold by Accused, who pointed his pistol and fired. Grazing witness's ear, and shoulder. Witness heard the bullet " click " into the fence behind. He called out for some people to go into the house. Accused also stepped back into the house and shut the door. Witness was joined by other people and went round to the front of the house. He then saw through the glass door accused standing in the passage. The accused then opened the front door and came out into the front garden, and again fired at witness. Accused then returned into the house, and witness heard farther shots within the house.
